Court dismisses Schwarzenegger's lawsuit



SAN FRANCISCO (AP) -- A federal appeals court dismissed a lawsuit Wednesday in which Gov. Arnold Schwarzenegger sued an Ohio car dealer for using his image in newspaper ads without his permission.
Fred Martin Motor Co. ran the ads portraying Schwarzenegger as the "Terminator" in 2002, before the movie star became California's governor. Schwarzenegger said the ad violated his right of publicity.
The 9th U.S. Circuit Court of Appeals said California courts had no jurisdiction to hear the case because the Akron-area car dealer had no connection with the state.
The ads "never circulated in California and Fred Martin had no reason to believe that any Californians would see it and pay a visit to the dealership," the court said.
The full-page advertisements displayed a photo of Schwarzenegger in his movie role as the "Terminator." A quotation next to the photo invited potential customers to "Terminate Early" on existing auto leases and purchase or lease from Fred Martin.
Schwarzenegger also has sued an Ohio bobblehead company, alleging it unlawfully used his image.
