YOUNGSTOWN -- A lawsuit over unauthorized use of images of Catherine Bosley in the nude has been settled and dismissed.
"The entire litigation is over," said Atty. Mark S. Colucci of Youngstown, who represents Bosley. He said terms of the settlement are confidential.
Bosley, a former reporter and news anchor at WKBN Channel 27, filed the lawsuit in February in U.S. District Court against several Web site operators and video distributors. She said they were using her nude image without her permission.
The images were of Bosley participating in a wet T-shirt contest in Florida while she and her husband were vacationing there more than a year ago. Bosley took off her clothes and danced nude in front of the crowd.
Pictures of the event later surfaced on the Internet, and Bosley was shown on a video called, "Dream Girls Spring Break 2003."
In the lawsuit, Bosley said she never gave consent -- either orally or in writing -- for the merchants to use her image; therefore, her right to privacy was violated. The matter was scheduled for trial in October.
What happened
Several of the defendants already had been dismissed from the suit by Judge James S. Gwin, including one represented by local lawyers John B. Juhasz and Ted Macejko Jr.
Because the settlement terms are confidential, Colucci could not say whether the settlement will result in Bosley's images being removed from the Internet and videos.
"All I can say is that I would be very surprised if they are still out there," Colucci said. "I would be even more surprised if they stayed up for any length of time after today."
Bosley resigned from WKBN earlier this year over fallout from the release of her nude images. Colucci said now that the case is settled, she hopes to resume her career locally in broadcast journalism.
