MAHONING COUNTY Charges add up in three courts



The Niles event triggered a probation violation hearing in common pleas court.

YOUNGSTOWN -- When charged with driving under suspension, Antoine Tate -- who is on triple probation -- told police: "You know I don't have a license; come on, man."
Patrolman Doug Pesa pulled over Tate around 2:30 a.m. Wednesday in the 100 block of West Philadelphia Avenue for failing to signal a turn. The officer said in his report that a check with the index operator downtown revealed that Tate was under four license suspensions, one of which resulted from a drug conviction.
At his arraignment Wednesday in municipal court, Tate, 23, of Argo Street, pleaded innocent to the latest DUS. Judge Robert A. Douglas Jr. allowed Tate to go free on his own recognizance. A pretrial is set for June 17.
Tate was in the news earlier this month after a near-riot at the Eastwood Mall. Charges of carrying a concealed weapon onto the premises of a liquor establishment and complicity to felonious assault were filed in Niles Municipal Court but later dismissed. It wasn't immediately clear if the charges would be directly presented to a grand jury.

Tate's arrest history in Mahoning County Common Pleas and Youngstown and Niles municipal courts:
UJan. 28, 2000, disorderly conduct. Youngstown Municipal Judge Robert P. Milich sentenced Tate to 30 days in jail, suspended 19 and gave him credit for 11 days already served. The judge also placed Tate on one year's probation.
USept. 11, 2000, aggravated robbery, felonious assault. Bound over to Mahoning County grand jury. Indicted with firearm specification on each count.
UOct. 4, 2000, two counts of drug abuse. Bound over to grand jury. Indicted. Charges combined with the case above.
UApril 6, 2001, disorderly conduct. Judge Milich sentenced Tate to 30 days in jail, suspended one and gave him credit for 29 served. The judge also placed Tate on one year's probation.
UMarch 28, 2002, sentenced in common pleas court after plea agreement for the combined cases from 2000. The felonious assault was amended to negligent assault (misdemeanor); the aggravated robbery was dismissed, as were the two firearms specifications. Tate pleaded guilty to the reduced assault and drug charges. Judge Jack Durkin sentenced Tate to one year's community control.
USept. 18, 2002, after a probation violation was established, Judge Durkin sentenced Tate to 60 days in the county jail and terminated the community control.
UJune 11, 2003, possession of cocaine; bound over to grand jury. Indicted.
UJune 11, 2003, sentenced in municipal court for DUS and failure to comply with a police order. Judge Milich gave Tate 180 days in jail, suspended 176 and gave him credit for four days already served. The judge placed Tate on one year's probation and ordered him to get a valid license. Tate still owes $160 fines and costs.
UDec. 30, 2003, DUS and loud music in a motor vehicle. Youngstown Municipal Judge Elizabeth A. Kobly sentenced Tate to 45 days in jail on the DUS and suspended 30. She gave him 30 days in jail on the loud music and suspended it all. The judge also placed him on one year's probation and ordered him to get a valid license. He still owes $239 in fines and costs.
UFeb.17, 2004, possession of cocaine charge from June 2003 reduced to a lesser felony. Judge Durkin sentenced Tate to two years' community control. This means Tate is on triple probation.
UApril 12, 2004, charged in Niles Municipal Court related to the Eastwood Mall near-riot.
UApril 28, 2004, charged with DUS in Youngstown.
UMay 10, 2004, probation violation hearing set in Judge Durkin's court. The arrest in Niles triggered this hearing.
