Court finds no basis for suit over voting



CINCINNATI (AP) -- A federal appeals court turned away a lawsuit Wednesday by people whose applications to register to vote on Kelleys Island were challenged because they were seasonal, rather than permanent, residents.
The 6th U.S. Circuit Court of Appeals said it found no basis for the lawsuit's claim that the Ohio law which allows registered voters to challenge the right of any person to vote violates federal law or the U.S. Constitution.
In February 2002, residents of the Lake Erie resort island challenged the local registrations of dozens of voters on the basis that they are only seasonal residents and make their permanent homes elsewhere. The Ohio Board of Elections and the secretary of state ultimately sustained the challenges against six people who had registered to vote on Kelleys Island.
The appeals court's ruling Wednesday upheld one by U.S. District Judge James Carr of Toledo in October 2002.
