WEATHERSFIELD TOWNSHIP Zoning board denies 2 requests

MINERAL RIDGE -- The Weathersfield Board of Zoning Appeals denied two variance requests Thursday.
Denied was a request for a variance to allow more livable structures to be built in Country Meadows Development, off Ohltown-Girard Road, than is allowed in a Residential-C district.
Paul Dieter of Dietlew Properties Ltd. appeared as a representative of the company. The company was granted a zone change from Residential-A and B to Residential C by the township zoning commission Wednesday.
The zoning permits multifamily dwellings. That decision must still be voted on by township trustees before it is given final approval. Trustees could also overturn it, but will need a unanimous 3-0 vote to do so.
Zoning inspector Sherri Craver said the variance the company sought from the board of zoning appeals was denied because Residential-C requires a 10-percent density of structure to land on a property. Dietlew's proposal to build 17 four-plexes on the property would have put the density at 18 percent for the structure.
Craver said Dieter did not indicate if the company would be changing its plans. She said the company can come back to the board with a different plan.
Also turned down
The board also denied a request from Tim and Sheryl Luman at 1688 Rosalyn Circle for a variance to allow a 6-foot high fence to go past the front of their house.
The board said the Lumans failed to prove a hardship, which would have been necessary for the board to allow the fence they have on the side of their house to continue at the 6 feet height past the side of the property, from the corner of the front of their house.
Zoning law requires that a fence from the side of a front of a house has to be 3 feet high.
