Charges against couple dismissed



CANFIELD -- A judge has dismissed charges stemming from a confrontation between a lieutenant at the Trumbull Correctional Institution and his ex-wife, an Austintown police officer, while she was on duty.
Kathy Dina, 38, was charged with criminal trespassing, and Joseph Dina, 36, was charged with domestic violence. The charges were dismissed last week by Judge Scott Hunter in Mahoning County Court in Canfield.
Judge Hunter dismissed the charges when she asked to have the charges against Joseph Dina dismissed, and he asked to have the charges against Kathy Dina dismissed.
Austintown police reports state Kathy Dina went to Joseph's Austintown home while she was on duty Nov. 23 to discuss custody of their children.
She said he slammed a door on her and injured her back and shoulder when she wouldn't leave, reports state. He told police he didn't slam the door on her; a witness said the door was shut on Kathy Dina's foot.
Kathy Dina was later suspended for five days without pay by Austintown Township trustees for ignoring a supervisor's warning not to go to her ex-husband's house while she was on duty, as well as for cursing and not acting courteously while on duty.
The cases against the Dinas were transferred to Canfield from county court in Austintown because of a conflict of interest with Austintown Judge David D'Apolito.
