MAHONING COUNTY Judge OKs expunging request



A prosecutor said there was no reason to oppose the request.

YOUNGSTOWN -- The name of William Dundee soon will disappear from the records of Mahoning County Common Pleas Court.
A judge has approved Dundee's request to have records of his criminal conviction for theft-in-office expunged and sealed from public view.
"It's like getting rid of an ugly tattoo," Dundee told visiting Judge Charles J. Bannon during a hearing Friday. "I appreciate this."
Dundee, 56, of Canfield, is a former Youngstown Street Department superintendent. He pleaded guilty in July 1997 to stealing $2,100 in proceeds from sale of city scrap metal.
Completed probation
A five-year prison sentence was suspended and Dundee was placed on probation for three years, which expired in December 2000. He filed for the expungement earlier this year.
During the hearing, which was conducted in Judge Bannon's chambers, Dundee said he has no other criminal convictions on his record and there are no charges pending against him. He completed his probation, paid back the $2,100 and has met all requirements for expungement, he said.
Assistant Prosecutor Robert Andrews said there was no reason for his office to oppose the request.
"I'm glad to do this," the judge said as he signed the expungement order. "Good luck."
The judge said records of Dundee's conviction and sentence must be removed from the court files as well as from any other state law enforcement agency that had made a record of it.
Dundee retired from the city in 1997 and works as a courier for an area bank, delivering computer tapes.
