COLUMBIANA COUNTY Lawsuit asks Lisbon to pay for costs of closing landfill



The township claims the village agreed to share landfill expenses in 1981.
LISBON -- Center Township is asking a judge to force Lisbon to help pay the estimated $1.45 million cost of closing a landfill the township says was jointly operated by the two entities.
The township filed a lawsuit earlier this week in Columbiana County Common Pleas Court seeking the judgment.
Judge David Tobin has been assigned the case.
The township argues that in 1981 it entered into an agreement with the village to jointly lease a landfill and share expenses for the facility.
The landfill is on township-owned land, but the lawsuit does not specify where.
On the advice of the county health department, the landfill was closed in December 1988. The health department had advised that the landfill be closed because more restrictive regulations were to take effect Jan. 1, 1989.
Estimated cost of permanently closing the landfill in accordance with Ohio Environmental Protection Agency requirements is $1.45 million, the lawsuit states.
The township believes the village should share that cost and has been seeking for more than a decade to resolve the issue, the lawsuit states.
"The village continues to refuse to share in the expense of closing the landfill," the lawsuit adds.
The township is asking the court to order the village to pay half the closing costs and for all the court costs and attorney fees incurred by the township in bringing the lawsuit.
Lisbon Mayor Jeffrey Snyder, who is named as a defendant in the suit, was unavailable Tuesday.
