Suit alleges sheriff failed to evict renter

YOUNGSTOWN -- A Cleveland-based real estate management company is suing Mahoning County Sheriff Randall Wellington, saying he has refused to evict a woman despite a court order to do so.
Wellington said he is not aware of either the situation or the complaint and declined to comment.
The suit was filed this week in the 7th District Court of Appeals by GMS Management Co., which owns property on South Raccoon Road in Austintown Township. It says a woman who rents an apartment there has defaulted on her lease and that an eviction order was issued Nov. 3 at the county's area court in Austintown.
The complaint says Wellington was ordered by the Austintown court to evict the woman within 10 days but has failed to do so.
The company is asking the court to force Wellington to evict the woman and restore the property to the company.
