General information
Listed here are siting criteria and operational requirements for landfills. Pennsylvania, New York and New Jersey are included because much of the construction and demolition debris waste coming into Mahoning Valley landfills is from those states, which make no distinction between construction and demolition waste and regular garbage and whose dumping fees are much higher:
FLOOD PLAIN
Ohio and Pennsylvania: Facility cannot be located in a 100-year flood plain.
New York: If the landfill is in a 100-year flood plain, operators must show the facility will not restrict or reduce holding capacity of the flood plain or result in a washout of waste.
New Jersey: NA*
WATER SOURCE
Ohio: Prohibited within the boundaries of a primary water source.
Pennsylvania: Prohibited within a quarter-mile upstream or 300 feet downstream of a public or private water source.
New York: Prohibited over primary water supplies or within a public water supply.
New Jersey: Waste cannot contact or have the potential to contact surface or ground water.
WETLAND
Ohio: NA*
Pennsylvania: Operation is prohibited within 100 feet of a wetland.
New York: A new facility cannot be constructed or operated within the boundary of a regulated wetland.
New Jersey: NA*
SCHOOL, PARK OR PLAYGROUND
Ohio: NA*
Pennsylvania: Facility is prohibited from operating within 300 yards of a building of instruction owned by a school, park or playground.
New York: NA*
New Jersey: NA*
PROPERTY LINE
Ohio: NA*
Pennsylvania: Operations prohibited within 900 feet of an occupied dwelling.
New York: NA*
New Jersey: NA*
FIRE PREVENTION
Ohio: Facility must operate in a manner that prevents fires and must have adequate fire control equipment, material and services to control fire and explosions.
Pennsylvania: NA*
New York: Operation manual must contain a description of actions to be taken in response to fires.
New Jersey: Equipment must include hand-portable dry chemical extinguishers, an automatic fire suppression system and other safety equipment.
