OEPA asks court to scrap variance involving household waste, landfills
LISBON -- The Ohio Environmental Protection Agency is asking a court to toss out a measure it says allows household waste to be accepted by construction and demolition debris landfills in Columbiana County.
The OEPA filed a lawsuit in Columbiana County Common Pleas Court against the county health district, contending a variance the health district board adopted Aug. 22 allows the four C & amp;DD landfills in the county to accept solid waste, which they should not be allowed to do.
The variance "creates a potential threat of harm to public health and safety and the environment," the lawsuit says without elaborating.
The lawsuit is asking the court to scrap the variance and issue an injunction banning the landfills from using the variance to justify accepting solid waste.
Named in the lawsuit are A & amp;L Salvage Inc., state Route 45 near Lisbon; Elkrun Industries Inc., state Route 7 near Rogers; SR Recycling Inc., U.S. 30 near Hanoverton; and Total Waste Logistics in Middleton Township.
The case is assigned to Judge C. Ashley Pike.
