Man gets 60 days in jail for violating probation terms
YOUNGSTOWN -- Terrance V. Rudolph was given a 60-day jail sentence Wednesday in Mahoning County Common Pleas Court for violating terms of his probation on a domestic violence charge.
Judge R. Scott Krichbaum gave Rudolph credit for more than 60 days he's already spent in jail awaiting a hearing. Rudolph could not be set free, however, because he is awaiting another hearing before Judge Robert Lisotto of common pleas court, also for a probation violation.
Testimony showed that Rudolph, 30, of Mineral Springs Road, tested positive for cocaine while a resident of Community Corrections Association with work-release privileges.
Defense lawyer Dennis DiMartino argued that the test results should be thrown out because there was a flaw in the way Rudolph's urine specimen was collected, but Judge Krichbaum did not agree.
The judge previously dismissed a separate probation complaint that alleged Rudolph had run his ex-girlfriend off the road while on work release. One set of affidavits stated he was at work while another set says he was not at work when the ex-girlfriend said he confronted her.
