TRUMBULL COUNTY Grand jury issues no indictment against man in obscenity case



The couple will try to get their children out of foster care, an attorney said.

WARREN -- The Trumbull County grand jury has declined to indict a man on a felony charge of pandering obscenity involving a minor.
The grand jury issued the no bill Wednesday on Dennis Harvey's case.
"We are very, very pleased," said Atty. John Fowler, Harvey's defense counsel. "The grand jury looked at the evidence and saw that there was no crime. We are now going to work to make sure Mr. Harvey's two children are allowed to come back home with him and his wife."
The Harveys' two children have been with foster care since the couple was arrested in April on felony charges of pandering obscenity involving a minor.
Wife's charge dismissed
The felony charge filed against Harvey's wife, Sandra, was dismissed last month when municipal court prosecutors said Sandra Harvey did not snap a photograph that shows her husband taking a bath and the couple's fully clothed 2-year-old daughter standing next to the tub.
The photograph was taken by the couple's 11-year-old son, Fowler said. The boy has not been charged.
Dennis Harvey was taking a bath when the two children walked in, and the older one took the picture, Fowler said.
Police began investigating Sandra and Dennis Harvey, of 174 Martin Luther King Blvd., earlier this month after employees at the Parkman Road Kmart gave them three pictures from the roll of photos the couple dropped off to be developed.
All three of the pictures showed Dennis Harvey in the bathtub. Only one of the pictures shows the girl.
The 41-year-old man was involved in programs at Fairhaven, the county's school for people who are mentally retarded and/or developmentally disabled, officials say, but he was considered fit enough to hold a driver's license.
