LISBON Controlled burn leads to lawsuit
LISBON -- A man is suing the Rogers Volunteer Fire Department and its chief, saying a controlled burn the department was conducting got out-of-hand and damaged his property.
Theodore Lutton, 45716 Clarkson Road, Rogers, filed a lawsuit recently in Columbiana County Common Pleas Court.
Besides the fire department, Lutton also names Fire Chief Robert Mercer as a defendant.
The suit claims that the fire department did a controlled burn Sept. 11 of debris from a previous fire. The suit doesn't specify where the controlled burn occurred.
The fire got out of control, and Mercer refused to send additional trucks to the scene to contain it, the lawsuit states.
As a result, damage to property and structures at the scene occurred, the lawsuit states without specifying.
Mercer was unavailable to comment Monday.
Lutton is seeking $25,000 in damages.
The case is assigned to Judge C. Ashley Pike.
