YOUNGSTOWN Judge sets Koliser trial for July 28



Defense lawyers are considering asking that the trial be moved out of the county.
YOUNGSTOWN -- Trial is scheduled for July 28 for Martin L. Koliser Jr., who is accused of killing a Youngstown policeman and shooting another man.
Koliser, 30, of Boardman, made his first appearance this morning before Judge R. Scott Krichbaum of Mahoning County Common Pleas Court on charges of aggravated murder, attempted murder, escape and illegal possession of a weapon.
Because he hasn't waived his right to a speedy trial as allowed under Ohio law, lawyers said they will prepare for trial at the end of July.
Koliser, with his hands cuffed and feet shackled, seemed uninterested during the hearing, at one point turning to stare at a mural in the courtroom.
Prosecutor Paul Gains said he expects the trial to last about five days. Koliser's lawyers, Jerry McHenry and William J. Mooney, assistant Ohio public defenders, said they have discussed asking that the trial be moved to another county though no decision has been made.
Police charged Koliser with attempted murder in the shooting of Donell J. Rowe outside the Casaloma Gardens bar on Mahoning Avenue on the city's West Side. Police also charged him with aggravated murder in the shooting death of Youngstown Patrol Officer Michael Hartzell.
Koliser also has been charged with violating his parole. He faces the death penalty if convicted.
