LORDSTOWN Transport service for seniors hits snag



Attorneys must address the contract before the service can begin.

LORDSTOWN -- Technical jargon between insurance companies is becoming a minor stumbling block in getting transportation for residents who need it.
Village officials are working with Antonine Sisters Adult Day Care Inc. in North Jackson to get the services for the elderly and handicapped in the village.
Council gave a second reading to an ordinance Monday, but the contract language is becoming a problem.
Solicitor Paul Dutton said it's routine practice for the village in such situations to be named as an insured third party on the policy of the agency providing the services, but Cincinnati Insurance Co., which provides coverage to the nonprofit agency, was not willing to list Lordstown so officials looked to their own provider, Love Insurance Co.
Dutton said Love was willing to cover the transportation service, but only if the contract includes a "hold-harmless" clause that would protect the village from financial claims if someone were injured using the service.
Agency doesn't want clause
Councilman D. James London said Sisters of Antonine will not sign the contract if the clause is included. Dutton said he needs to speak with attorneys for the agency to clear up the matter.
"But the bottom line is, unless you are covered, my advice is don't enter into this contract," he said.
Council is expected to act on the contract at a meeting Aug. 11.
Village leaders are eager to get an agreement worked out.
"I've gotten calls from a few people who want us to get this going and soon, because Mom or Dad want to go places and are ready to get the car out of the garage and go, and I don't think the kids want that," said Mayor Arno Hill.
Sisters of Antonine provides several services to area seniors, including physical, occupational and speech therapy.
Through the District XI Area Agency on Aging, the center is also approved for the Caregiver Support Program, which allows staff to care for those with Alzheimer's disease.
