LISBON Trooper to challenge DUI evidence



LISBON -- An Ohio State Highway Patrol trooper charged earlier this summer with driving under the influence of alcohol is seeking to scrap the blood-alcohol level evidence in his case.
Trooper Donald Walker, 34, of the OSHP's Southington Post, appeared Monday in Columbiana County Municipal Court for a pretrial hearing.
Judge Mark Frost continued the hearing until 2:15 p.m. Sept. 15 to allow Walker's lawyer, Atty. Philip Vigorito of Warren, time to prepare a motion.
The motion will challenge the calibration of the equipment used to measure Walker's blood-alcohol level, Vigorito said.
Walker's level was measured at 0.12, which was over the 0.10 legal limit at the time. The limit has since been dropped to .08.
Vigorito added, without elaborating, that he also will challenge whether a trooper from the Lisbon post had probable cause to arrest Walker on June 11 on state Route 11.
Walker was pulled over, accused of going 91 mph in a 65-mph zone. The traffic stop led to the DUI charge and a speeding citation.
Walker has pleaded innocent to both offenses and remains free on bond.
If convicted of the misdemeanor charges, Walker faces up to six months in jail and a $1,000 fine.
