NILES Grand jury to hear case of intimidation charge

NILES -- A second felony charge against a Belle Terre Avenue man will be heard by a Trumbull County grand jury.
Acting Judge John R. Gargano of Niles Municipal Court ordered the case against Richard P. Marburger, 47, be bound over. Marburger is accused of intimidating a teenage boy who initially accused him of stalking.
Marburger did not take the stand during four witnesses, including the victim and Marburger's daughter.
The boy said he was walking home from Edison Junior High School around 2:30 p.m. June 2 when Marburger pulled up outside the General Electric plant at Main and Federal streets and asked if he was the one who had charges against him.
"He told me if this goes any further than it has now and he gets in trouble, he'll hurt me and my family," the boy, who has since turned 15, said.
How this began
Marburger was originally charged last April with menacing by stalking. Reports said Marburger followed the boy to and from school in a blue van and tried to get the boy to get into the vehicle.
Reports do not indicate Marburger had any physical contact with the boy.
The grand jury indicted Marburger on that charge June 5.
The boy testified Marburger was in a red truck with a trailer attached carrying lawn-mowing equipment. Defense witnesses said Marburger was home at the time and does not own a red truck, nor does he mow lawns for anyone.

His daughter said she was home that afternoon, and her father did not leave the house until after 3 p.m. to pick up her sister at her grandmother's home.
Gargano ordered Marburger's bond continued. He remains free on $5,000 bond.
