Reports said the neighbor was walking through the alley when Hilty approached him with the shotgun in his hands, which he then fired into the air. The man told police Hilty then went back into his home, returned with a board and struck him on the arm.
When police searched the home Hilty was in, they found the gun in the attic with a spent shell casing next to it, and also recovered three shells in a bedroom and a partial box of ammunition.
