MERCER COUNTY Judge orders 2 men to prison



One man is going to prison for threatening to kill a woman.

MERCER, Pa. -- Two men have received prison terms for assaulting and threatening their victims.
Judge Michael Wherry of Mercer County Common Pleas Court sentenced Henry Provencher, 38, whose address was listed as the county jail, to 16 months to 10 years for felony aggravated assault.
The judge also ordered Provencher to pay court costs for simple assault and disorderly conduct, both misdemeanors. On Nov. 17, he attacked five Sharon police officers who tried to arrest him for assaulting a woman at an Ormond Avenue residence in Sharon.
Court documents say he pinned the woman to a bed, bruising her arms and cutting her hand. During the arrest, he kicked one officer in the head, another in the knee and another in the groin, elbowed another and injured a fifth's arm.
When taken to Sharon Regional Health System hospital's emergency room for treatment of his injuries, Provencher also yelled obscenities at the attending doctor and nurse.
Thomas Small, Jr. 39, of Young Road, Greenville, was sentenced to eight months to five years in prison for making terroristic threats.
Court records say that Dec. 15, 2002, he called a woman and threatened to come to her residence and kill her and her landlord. He arrived at the apartment on Kennard Road in Sugar Grove Township with a loaded handgun in his vehicle. He tried to punch the landlord and threw a rock at him.
Also sentenced
The judge also sentenced these people:
UBrian Baxter, 33, of Ormond Avenue, Sharon, was placed on four months' house arrest to be followed by three years' probation for theft by unlawful taking, a misdemeanor. In February 2002, he took parts of door locks and trim plates valued at under $2,000 from a residence on Chestnut Street, Wheatland.
UAndre Gillespie, 32, of A Street, Sharon, was placed on 120 days' house arrest followed by 36 months' probation for unlawful delivery of cocaine, a felony. Court documents say he sold 11 "rocks" of crack cocaine to a confidential informant for $40 in January.
UTimothy Holler, 49, of Railroad Street, Sharon, was sentenced to nine to 36 months in jail for misdemeanor forgery. In January, he forged three checks totaling $2,000.
URobert Little, 32, of A Street, Sharon, was sentenced to nine months to five years in prison and ordered to make $1,815 restitution for receiving stolen property, a misdemeanor. On Oct. 29, he disposed of five rifles and three pistols he knew were stolen.
UJoseph Passel, 40, of Emerson Avenue, Farrell, was placed on five years' probation and ordered to make $50 restitution for criminal conspiracy/unlawful delivery of cocaine, a felony. On two occasions in March, he conspired with another man to sell cocaine to a confidential informant for a total $150.
UGreg Shirley, 30, of New Castle Avenue, Sharon, was sentenced to one to two months in jail followed by four years' probation for theft by unlawful taking, a misdemeanor. In June 2002, he took $229 from a West Connelly Boulevard, Sharon residence.
UJoshua James Winkler, 21, of Pittsburgh, was sentenced to 30 days in jail for criminal mischief, a summary offense, and placed on five years' probation for theft by unlawful taking, a misdemeanor. In November, he stole $1,489 worth of miscellaneous items from Camp Nazareth on Pew Road, Delaware Township, and did $350 worth of damage to a camp window.
