COLUMBIANA COUNTY Court orders third sentencing for man convicted in shooting
LISBON -- An East Liverpool man will be resentenced for trying to kill his girlfriend's mother in 1998.
The 7th District Court of Appeals recently found for a second time that Columbiana County Common Pleas Court judges had failed to fully support their reasons for twice imposing the maximum 21-year prison sentence given to William Gist.
Gist must be resentenced for attempted murder, the appeals court said. Common pleas court must also re-examine its order for consecutive sentences for the attempted murder and an aggravated burglary charge.
Gist originally was sentenced in June 1999 by Judge Douglas Jenkins, now retired. Judge Jenkins imposed the maximum 10-year term for attempted murder and the maximum eight years for the burglary. Gist also was given three years for using a gun. He was ordered to serve the sentences consecutively.
He successfully appealed. Judge C. Ashley Pike, who replaced Judge Jenkins, resentenced Gist in January 2003 and handed down the same sentence.
But in the most recent appeal, the 7th District Court determined that Judge Pike erred in not stating his own reasons for the sentence, necessitating another resentencing.
Gist entered a home in Liverpool Township, took a rifle and shot at his girlfriend's mother, hitting her twice.
He has been serving the 21-year sentence.
