WARREN Judge orders lawyer to pay $100 fine

WARREN -- The lawyer representing a man whose violent arrest made national news has been found in contempt of court and must pay a $100 fine.
Judge Terry Ivanchak ruled Monday in Warren Municipal Court that Richard Olivito was in contempt of court while representing Lyndal Kimble on Aug. 7.
The judge ordered Olivito to make a $100 payment to the charity of his choice. The attorney has 15 days to pay the fine, Judge Ivanchak said.
Once the payment is made, the contempt charge will be dismissed.
"I'm glad it's over," Olivito said. "The judge said I could have another judge review it, but I just wanted to get it over with, and I believe Judge Ivanchak was very reasonable."
A $100 check will be sent to Second Harvest Foodbank, Olivito said.
The attorney apologized to the judge for his actions shortly after the Aug. 7 hearing.
Several times during Kimble's three-hour preliminary hearing, Olivito argued with the judge and Prosecutor Traci Timko-Rose and he made comments about the police department and the city.
Olivito said that the whole city is unconstitutional and that he didn't expect to get a fair hearing in municipal court.
Found probable cause
Judge Ivanchak, however, said the Kimble hearing was only to determine if police had probable cause to arrest the 29-year-old man on the felony charges.
The judge did find probable cause and sent the case to the county grand jury for consideration.
Kimble faces charges of felonious assault on a police officer, possession of drugs and tampering with evidence.
Olivito said he thinks police beat Kimble when they arrested him.
Kimble's arrest about 1 p.m. June 28 was videotaped by a neighbor. The videotape has been played on local and national news.
Kimble's neighbors testified they felt Kimble's life was in danger.
