CANFIELD Trustees vote to award paving pact
The judge removed himself from the Terminate-Hers case.
CANFIELD -- McCarty and Fairway drives are expected to be repaved by the end of September, township trustee Bill Reese says.
Trustees voted unanimously Monday night to award a contract for the $88,595 project to Cleveland Asphalt Inc.
The roads were expected to be repaved this summer under the township's annual repaving program.
Trustee Judy Bayus voted against the repaving program in June. A unanimous vote is needed to approve road improvement projects, unless residents of more than half of the homes on a road sign petitions seeking the work.
Bayus couldn't be reached.
Signed petitions
Reese had said more than half the residents of McCarty and Fairway drives have signed petitions seeking repaving since Bayus voted against the resolution. He noted the petitions weren't an issue Monday night.
Bayus said she voted against the resolution because she didn't want trustees to transfer money from the general fund into the road fund to pay for the work. She said she wants the township to pay using its permissive fund, as it has in the past.
Trustees had set aside $80,000 in general-fund money for the repaving program this year. Clerk Carmen Heasley said that money would be used to pay Cleveland Asphalt.; additional money will come from the permissive fund.
A group of residents has cited the vote on the repaving program as a reason Bayus should be removed from office. The group, called the Terminate-Hers, recently filed a complaint in Mahoning County Common Pleas Court seeking to have Bayus removed.
Judge Robert Lisotto was assigned to preside over a hearing but because he is a Canfield resident, he removed himself from the case Tuesday.
A new judge and date are pending.
Trustees also approved Monday a $74,000 project to remodel the county sheriff's substation behind township hall. Money for the project is to come from the township's share of the county sales tax.
Reese said he expects the project to be complete by the end of the year.
