State says Warren Recycling has violated consent decree
WARREN -- A spokesman for the Ohio Attorney General's Office says Warren Recycling Inc. is in violation of a consent decree reached last month because it hasn't paid a $30,000 penalty on time.
The $30,000 civil payment was due last Friday, Mark Gribben said.
An additional $17,000 in state tipping fees is due Sept. 1.
A consent decree was reached July 1 between the state and the companies that operate the Martin Luther King Avenue landfill.
The decree was to resolve violations at the landfill dating to 1999.
WRI officials couldn't be reached.
Gribben said the AG's office is weighing its options of what to do next.
In a worst-case scenario, the state could pursue a contempt hearing against the company in Trumbull County Common Pleas Court, where the consent decree was filed.
Preparation for such a hearing would be a waste of time if the payment is received before a court date, Gribben said.
"We're probably giving them a little bit of a window but not much," he added.
