Officer cleared of criminal misconduct



The officer, whose personal use of a borough computer was probed, has resigned.
SHARPSVILLE, Pa. -- No criminal charges will be filed against a borough police officer suspended from his job in June.
Meanwhile, the target of the probe has resigned his post.
No criminal activity
James Epstein, Mercer County district attorney, said Wednesday that his office has concluded its investigation into the case of Patrolman Thomas Borton and determined that "he didn't engage in any criminal activity."
Borton, a three-year veteran of the force and its K-9 officer, resigned from the force Friday.
He had been suspended with pay in mid-June, pending the investigation by the district attorney's office into allegations that he inappropriately made personal use of a municipal computer.
There was no criminal use of the computer, Epstein said, making the issue a disciplinary matter between Borton and the borough.
Resignation confirmed
Mayor Kenneth Robertson, who oversees the police department, confirmed that Borton submitted a letter of resignation Friday. Borton offered no explanation for his resignation in the letter, Robertson said.
The department now has four full-time and three part-time officers. The department's dog has been staying with police Chief Keith Falasco since Borton's suspension. A new K-9 officer hasn't been chosen, Falasco said.
