Lawsuit seeks removal of Canfield trustee

CANFIELD -- A group of township residents has asked a court to remove Canfield Township Trustee Judy Bayus from office.
The group, called the Terminate-Hers, filed a complaint Thursday against Bayus in Mahoning County Common Pleas Court. The complaint includes 880 signatures on petitions stating that Bayus has committed "misfeasance, nonfeasance and malfeasance" in office and should be removed.
In the complaint, the group accuses Bayus of failing to consider the needs of township residents and ignoring court orders regarding road maintenance. The group also accuses Bayus of changing township records and not signing employee checks.
Atty. Brian Macala, who represents the Terminate-Hers, said the group believes Bayus changed the township's meeting minutes.
He wouldn't comment further, noting that he didn't want to discuss evidence that would be presented in court. State law requires a court to have a hearing on the complaint during the next 30 days. No hearing date has been set. Under the law, Bayus only can be removed after a trial before a judge or a jury.
