Columbiana sues over sewer work



LISBON -- The city of Columbiana is suing a paving company over a project to install sanitary sewer lines on Pearl Street.
The city filed a lawsuit Monday in Columbiana County Common Pleas Court against Blacktop Pavers Sheet Metal Coatings Inc. of Massillon.
Among the claims made in the lawsuit is that the company began work in January 2001 and stopped working in October 2001, leaving the job substantially incomplete.
A representative of Blacktop was unavailable Monday to comment on the lawsuit.
Blacktop also left public rights of way and homeowners' yards in disarray, the lawsuit contends.
Also claimed is that Blacktop damaged fencing, a stone planter and utility lines.
The city also alleges in the lawsuit that Blacktop failed to properly account for materials, resulting in overpayment of $102,982.
The city is asking for a judgment against Blacktop that includes return of the overpayment plus $52,356 spent to correct deficiencies in the project.
