Man is acquitted of stealing cigars



YOUNGSTOWN -- After a trial in municipal court, Judge Robert P. Milich acquitted a man accused of stealing a box of cigars from Rite Aid on Market Street.
James M. Sellers, who had left his parole papers on the counter at the store, was represented by Atty. Albert A. Palombaro.
After the judge heard the testimony this week from a security officer, Palombaro made a motion to dismiss and the judge granted it, said Michael J. Krause, an assistant city prosecutor.
Krause said the security officer was the state's only witness.
The security officer had told police last month that Sellers, 32, of Idlewood Avenue, picked up the cigars then walked around the store. The price tag was later found but not the cigars worth $22.
Sellers had served time in prison for receiving stolen property, felonious assault and robbery. He was paroled in March.
