FAIRFIELD TWP. Couple sues neighbors



COLUMBIANA -- A Fairfield Township couple is suing their neighbors for just more than $300,000, alleging the neighbors' barking dog and other conditions on their property are a nuisance.
Daniel and Brenda Dillan, of 5046 Kirk Road, are suing Charles and Lynn Lanzendorfer of 4970 Kirk Road.
The lawsuit was filed recently in Columbiana County Common Pleas Court and will be heard by Judge C. Ashley Pike.
The Lanzendorfers could not be reached to comment.
Allegations: The Dillans say in the lawsuit that the Lanzendorfers have a large mixed breed dog that barks incessantly and without provocation. The Dillans also allege that the dog has often broken loose and menaced them, their family and their pets.
Another claim made in the lawsuit is that there are rats on the Lanzendorfers property and that the rodents come onto the Dillans' property.
The lawsuit also states that the Lanzendorfers allow firearms to be discharged in the direction of the Dillans' home.
As a result of the situation, the Dillans say, their property value has been reduced and they are suffering anxiety and the loss of the quiet enjoyment of their home.
Seek order, damages: They are asking the court to order the Lanzendorfers to remedy the barking and other conditions.
The Dillans also seek $303,500 in damages.
