YOUNGSTOWN POLICE Female officer files lawsuit alleging sex discrimination

YOUNGSTOWN -- A female detective sergeant has sued the city and its police department in U.S. District Court, alleging that her civil rights were violated when she didn't receive captain's pay when she was assigned to perform captain's work for several full eight-hour shifts.
In the sex discrimination suit, filed by Atty. Marc Dann, Detective Sgt. Delphine Baldwin-Casey seeks $100,000 in compensatory damages and $500,000 in punitive damages and asks for a jury trial.
She said she was the only woman affected and the only sergeant not paid the higher out-of-rank pay as required under the police labor contract. Male sergeants always got out-of-rank pay under similar circumstances, the suit alleges.
The suit says the city violated the Civil Rights Act of 1964 and the equal protection of the law provisions of the Fifth and 14th amendments to the U.S. Constitution.
Police spokesmen were unavailable for comment Friday night.
The case is assigned to U.S. Magistrate George Limbert.
