WARREN -- A 51-year-old Bristol man who pleaded guilty to a count of child endangering has been sentenced to 45 days in the county jail and four years' probation.
Judge John Stuard of Trumbull County Common Pleas Court sentenced Roy E. McDaniel Thursday during a brief hearing.
Atty. John Large had asked the judge to delay McDaniel's sentencing for a few days because McDaniel has a doctor's appointment and may have to undergo a shoulder operation.
The judge denied the request, saying McDaniel must begin serving the jail sentence immediately.
Parole conditions: The judge also said that when McDaniel is paroled he must remain employed, attend parenting classes and not use any alcohol or drugs.
McDaniel could have faced up to five years in prison, court officials said.
McDaniel's girlfriend, Angelique Bailey, 35, has also pleaded guilty to a charge of child endangering and is awaiting sentencing.
Thomas J. McDaniel, 14, Roy's son, pleaded guilty in juvenile court in October to one delinquency charge of rape.
He was sentenced to one to seven years in an Ohio Department of Youth Services facility.
In exchange for his plea, prosecutors dismissed one delinquency charge of rape and one delinquency charge of felonious assault.
Child raped: Authorities said Thomas raped a 5-year-old girl in a state Route 88 home McDaniel and Bailey shared with their children in July while he was baby-sitting the girl and two other children.
The girl spent several weeks in a hospital.
Deputies said Thomas McDaniel was often left alone in charge of younger children. He told authorities he and the younger children -- 8, 5 and 2 -- were left alone for days at a time.
Bailey is the mother of the 8-, 5-, and 2-year-olds, and a 10-month-old.
Roy McDaniel is the father of Thomas and the 8-year-old.
All the children are in the custody of Trumbull County Children Services.
The youngest child, then 2 months, was with Bailey and McDaniel on the day the 5-year-old was raped, authorities said.
Detectives say the house has been condemned by the county health department.
