WARREN Company sues over concert

ICM said it would provide Soul Decision and Evan and Jaron as opening acts for 98 Degrees.
WARREN -- Cafaro Stadium Co. has filed a lawsuit against International Creative Management Inc. of New York, contending the company breached its contract by failing to provide two musical groups for an Aug. 16 concert.
The action, filed Monday in Trumbull County Common Pleas Court and assigned to Judge Peter Kontos, seeks more than $25,000 in damages. No hearing date has been set.
ICM officials could not be reached.
Problem: The suit contends that the agency told Cafaro officials in the spring of 2001 that they would provide 98 Degrees as the headline group and Soul Decision and Evan and Jaron as support groups for an August concert at Cafaro Field in Niles.
In the middle of June, ICM officials said they could not provide Soul Decision and Evan and Jaron, but, instead, would provide City High and Willa Ford.
The companies agreed that for $130,000, 98 Degrees would perform and for an additional $15,000, City High and Willa Ford would provide the opening acts. On June 15, Cafaro sent a deposit of $72,500 to ICM, the suit states.
However, shortly after receiving the deposit, ICM officials said they would not be providing City High or Willa Ford, but would send the groups Valeria and PYT.
Two weeks before the concert, ICM notified Cafaro that only PYT would perform. Cafaro officials then hired a local group, Bonilla, as an opening act, the suit states.
On Aug. 10, Cafaro officials were told that 98 Degrees would not perform unless the balance owed, which was $72,500 was sent by Aug. 16.
That left the stadium company in a position of having to pay $145,000 for concert talent without getting any of the support groups ICM agreed to provide. The stadium company suffered loss of ticket sales and paid for groups that did not perform, the suit states.
