Hospital, police accused of mistreatment
WARREN -- An Austintown man and his mother have filed a lawsuit against the Girard Police Department and Forum Health for injuries they say he suffered three years ago.
The suit was filed by Atty. James Lanzo Jr. on behalf of Gary McClellan and his mother, Loretta Klempay, both of Oakleigh Avenue, and seeks an unspecified amount of damages.
Accusations: The lawsuit alleges that police beat and maced McClellan and used a stun gun on him while arresting him Sept. 25, 1998, when he was a juvenile.
The police action "amounted to an assault and battery" on McClellan, the suit alleges.
A police spokesman could not be reached for comment.
The suit also contends that while he was at Northside Medical Center, a Forum Health facility, medical workers tore his urethra while attempting to insert a catheter to get a urine sample.
As a result, McClellan has suffered physical pain and emotional distress, and his mother had to pay her son's medical expenses, the suit says.
A Forum Health spokesman could not be reached to comment.
