WARREN Boy receives 7-year sentence for raping 5-year-old

The boy will be placed in a sex offender treatment program until he's 21.

WARREN -- A 14-year-old Bristol Township boy, who pleaded guilty to raping a 5-year-old girl, has been sentenced to one to seven years in an Ohio Department of Youth Services facility.
Atty. David Toepfer, an assistant Trumbull County prosecutor, said Thomas J. McDaniel pleaded guilty to one delinquency charge of rape.
In exchange for his plea, prosecutors dismissed one delinquency charge of rape and one delinquency charge of felonious assault.
"He can only be held until he is 21," Toepfer said. "So the maximum number of years he can serve is seven."
Toepfer added that the boy will be placed in a sex offender treatment program while at the DYS.
Court officials said the boy made no comment during the hearing in Judge Pamela Rintala's courtroom. Juvenile court proceedings are not open to the public.
Atty. Robert Kokor, who represented McDaniel, could not be reached to comment.
What happened: Trumbull County deputy sheriffs said McDaniel raped a 5-year-old girl in his state Route 88 home in July. Police say McDaniel was baby-sitting the girl and two other children at the time.
The girl spent several weeks at Forum Health Tod Children's Hospital, Youngstown.
Deputies said McDaniel was often left alone in charge of younger children. McDaniel told officials that he and the younger children, ages 8, 5 and 2, were left alone for days at a time.
The boy's father, Roy E. McDaniel, 51, and his girlfriend, Angelique Bailey, 35, have pleaded innocent to child endangering charges. Their cases are pending.
Children in custody: Bailey is the mother of the 8-, 5-, and 2-year-olds, and a 2-month-old child. Roy McDaniel is the father of Thomas and the 8-year-old. All the children are now in the custody of Trumbull County Children Services, officials said.
Detectives say the two adults lived at the home with the five children. The 2-month-old child was with Bailey and McDaniel on the day the 5-year-old was raped, officials said.
