WARREN Attorney says access to inmate was prevented
The lawyer wants the charges against his client to be dismissed.

WARREN -- An attorney representing a Trumbull Correctional Institution inmate is asking a judge to toss out charges pending against his client because he has not been able to speak with the man.
Judge W. Wyatt McKay of Trumbull County Common Pleas Court said he will listen to Atty. Anthony Consoldane's arguments on Daniel Ginley's case at 1 p.m. Friday.
Consoldane, of the Ohio Public Defender's Commission, told the judge during a hearing Wednesday that Ginley's trial is scheduled for Monday and he has yet to be able to talk to him.
Ginley is facing two charges of complicity to illegal conveyance of weapons and or prohibited items onto the grounds of a detention facility.
Consoldane said his client is accused of trying to smuggle drugs inside the prison.
"I went out to the prison last week before 2 p.m. and wanted to meet with my client," Consoldane said. "The guards were giving me a runaround and by the time they agreed to let me go back and talk to him they said I was too late. It was about 2:16 and they told me that I needed to be there by 2:15."
Consoldane said he needs to talk to his client so he can prepare for his defense.
"This case goes to trial in five days and I am not prepared," Consoldane said.
Problem resolved: Atty. Chris Becker, an assistant Trumbull County prosecutor, said he talked to prison officials and has been assured that as long as Consoldane goes to the prison during visiting hours he will be allowed to talk to his client.
"Just dismiss this case because they won't even bring him here," Consoldane told the judge, noting that Ginley was scheduled to be in court Wednesday but prison officials did not bring him to the court.
The judge said he would make a decision on Consoldane's request during Friday's hearing.
Court officials said that prison guards did not know they were supposed to bring Ginley to court Wednesday.
