YOUNGSTOWN Suit seeks to get help for girl in baby killing

The girl's lawyer said he won't leave the juvenile center without her.

YOUNGSTOWN -- A local attorney says it's time for Jackie Colon to be taken out of the Mahoning County Juvenile Justice Center and put into a psychiatric treatment facility.
Atty. Mark S. Colucci filed a lawsuit today in common pleas court seeking to force the release of Colon, 14, who has been in the juvenile center since December.
Colucci said he wants Colon immediately taken to the nearest psychiatric facility, at the state's expense.
Baby stabbed: Colon is accused of throwing 3-month-old Alex Zalovcik out a second-story window in December, then going outside and stabbing the infant nearly 60 times with two knives.
In March, she was found mentally incompetent to stand trial and was ordered into a residential treatment facility. Despite the court order, she has not been moved from the juvenile center because officials say they have been unable to find a facility suitable for her needs.
The suit, filed by Jackie's mother, Michelle Colon of Nantucket Drive, Austintown, says the girl is being subjected to cruel and unusual punishment by being kept in the juvenile lockup, where she eats her own feces and walks naked among the other juveniles.
Colucci said he planned to go to the juvenile center today to visit Jackie.
Is adamant: "I'm not leaving without my client," he said. "If that means sleeping over there a week, then I'll be there sleeping on the street corner."
The suit names several city and county agencies, Forum Health and the D & amp;E Counseling Center as defendants. They are also named in a suit Colucci filed several weeks ago on behalf of baby Alex's mother, Dawn Mraz of Pine Hollow Drive.
Colucci said there is no conflict of interest in his representing both Jackie and the victim in the matter.
"They don't have a conflict of interest; they have a common interest," he said, noting that Mraz and Michelle Colon had signed a waiver allowing him to represent them both.
