Couple sues city over decision to raze

WARREN -- A Youngstown couple is suing Warren's board of health, appealing its decision to demolish a home they own at 938 Highland Ave. S.W.
The lawsuit was filed Friday in Trumbull County Common Pleas Court, assigned to Judge W. Wyatt McKay.
In early May, the city condemned the house and asked its occupants to vacate the premises, the lawsuit says.
According to the lawsuit, Scott and Kimberlee Nevel of Bancroft Avenue own the home but rent it out to another family.
The health board held a hearing in June and in July ordered the house be demolished.
The Nevels are asking for a reasonable amount of time to make repairs and make improvements to comply with housing codes.
Demolition will cause immediate and irreparable injury, loss and damage to the Nevels, the lawsuit says.
They are also asking the court to issue a preliminary injunction and temporary restraining order until the appeal is heard.
Bob Pinti, the city's deputy health commissioner, said Friday he hadn't seen the lawsuit.
Legal wrangling will hold up demolition of the property, Pinti said, adding that the property is in extremely poor condition.
The Nevels were unavailable Friday.
