Lordstown sues over tennis court

WARREN -- Lordstown wants a Trumbull County Common Pleas Court judge to order a Canfield paving company and a Westfield Center bonding company to pay damages for work on the village tennis courts.
Atty. Paul Dutton, village solicitor, filed a lawsuit on the village's behalf Friday seeking unspecified damages from R.T. Vernal Paving Co. Inc. and Ohio Farmers Insurance Co.
The paving company was awarded the contract in 1998 to reconstruct tennis courts in a village park. The company was paid $110,208 for the work. After the project was done, the village noticed problems, including bumps in the asphalt and stains on the surface of the tennis courts, the lawsuit says.
The company was bonded by Ohio Farmers Insurance of Westfield Center, but according to the lawsuit, the bond incorrectly states its effective dates from September 1998 to September 1999.
The village requires a guarantee for the faithful performance of repairs for one year beginning upon the date of acceptance of the work, the lawsuit said.
The village didn't accept the work until October 1999.
