Man sues village over denial of waterlines to development



LISBON -- A village man is suing the village and village council, alleging they're wrongly denying municipal water to a housing development he's planning.
Dean Rose, 7735 state Route 45, is seeking unspecified compensatory damages in the lawsuit he filed Monday in Columbiana County Common Pleas Court.
Rose said he wants to build a 50-unit housing development for people 50 and older. The development is to be north of the village limits on Hunters Camp Road.
Rose has requested village water service for the proposed development through Mayor Jeff Snyder and village council. But the village has denied the request, saying that first, the development site in Center Township must be annexed into the village.
Contention: The village's refusal is "wrongful and without legal basis," Rose argues.
A village spokesman was unavailable to comment on the allegations.
Rose is asking the court to order the village to approve his request to provide water to the development. He is being represented by Atty. Craig Pelini of North Canton.
