Canfield dog-breeding facility accused of polluting

YOUNGSTOWN — The Ohio Attorney General’s office filed a lawsuit that accuses a Canfield dog-breeding facility of illegally disposing of pollutants.

The lawsuit was filed against Thomas Fidoe and Eagles Nest Enterprises LLC which own Eaglecross Kennels at 9424 Columbiana-Canfield Road. It also names Gregory Fidoe, who operates the dog-breeding operation, according to the lawsuit.

It claims animal waste was disposed of in a marsh that flows into a tributary of Indian Run and Mill Creek on at least June 4, 2015, Feb. 14, 2017, and Dec. 7, 2017 without the required permits.

The defendants illegally discharged pollutants to waters of the state, caused a public nuisance and failed to apply for permits to install a holding tank and leaching field on the property, according to the lawsuit.

The Attorney General’s office seeks an injunction to prevent future violations and a court order that requires the defendants to apply for the required permits. It also seeks $10,000 in fines for each day the defendants violated the law.
