No negligence found in Mass. centenarian death
DARTMOUTH, Mass. (AP) — An arbitrator has found no negligence by a Massachusetts nursing home in a wrongful death lawsuit brought by the family of a 100-year-old woman who prosecutors say was killed by her 98-year-old roommate.
A lawyer for Elizabeth Barrow’s family tells The Standard-Times that the arbitrator ruled in the Dartmouth nursing home’s favor. He says he plans to appeal and is barred from saying anything else.
The top official at Brandon Woods Nursing Home and Barrow’s son say they, too, have been ordered not to discuss the case.
Barrow was found in bed with a plastic bag over her head in September 2009. Her death was ruled a strangulation.
Her roommate, who is now 100, is charged with second-degree murder. Prosecutors say she has been found incompetent to stand trial.
