Ohio AG seeks dismissal in gay-marriage challenge

COLUMBUS (AP) — Ohio’s attorney general has asked the state’s highest court to dismiss a legal challenge to a proposed constitutional amendment that would allow gay marriage in the state.

Attorney General Mike DeWine said in a motion filed Friday that the Ohio Supreme Court lacked jurisdiction over the legal challenge by opponents of the measure.

The Freedom to Marry coalition wants to repeal a 2004 state constitutional amendment that says Ohio only recognizes a marriage between a man and a woman. The group’s proposal would replace that amendment with one that allows two consenting adults to enter into marriage regardless of their gender.

The Ohio Campaign to Protect Marriage claims DeWine shouldn’t have verified the coalition’s amendment summary. DeWine cleared the language in early April.
