Grand jury indicts man who was fired at by police

A Mahoning County grand jury handed up an indictment against the 55-year-old city man fired upon by police during an altercation Aug. 12.

The shooting occurred about 9:20 a.m. in the 400 block of Belle Vista Avenue on the West Side. Officers were on their way to the scene after a 40-year-old city man told police Raymond Spires shot at him after he accused Spires of animal abuse.

Officer Daniel Mikus saw Spires on a bicycle and stopped his cruiser.

Mikus was told by police dispatch that Spires’ backpack likely contained a weapon, and the officer recognized Spires as the person he had met with four months earlier when Spires was accused of setting an occupied apartment complex on fire, reports state.

Mikus said he yelled for Spires to get on the ground no fewer than 20 times and that Spires challenged the commands by talking to the officer by name. Spires came toward the officer, appearing angry with his hands clenched.

The officer fired at Spires’ right foot, and only then did Spires get on the ground, reports say.

Police department officials reprimanded Mikus for the manner in which he fired the shot at Spires.

Spires was indicted on two counts of felonious assault with a firearm specification.

The grand jury Thursday also indicted these people on the following charges:

Michael Miller, 18, Canfield Road, burglary.

James Jones, 26, Morley Avenue, Campbell, failure to comply with the order or signal of a police officer.

Michael Ware, 33, Breaden Avenue, possession of cocaine.

Jesse Cooper, 57, Frederick Street, Austintown, possession of cocaine.

Marcus Parish, 24, Rutledge Avenue, illegal possession of a weapon.

Sierra Madison, also known as Stacy Clark, 23, West Washington Street, New Castle, Pa., possession of cocaine.

Phillip Payden, 26, Cornell Avenue, failure to comply with the order or signal of a police officer.

Matthew Spain, 28, Ridge Avenue, failure to comply with order or signal of a police officer.
