$750K judgment awarded to wife

LISBON

Patricia Athey, the executor of the estate of her husband, Larry Athey Sr., has been awarded a $750,000 judgement by Columbiana County Common Pleas Court Judge C. Ashley Pike.

Judge Pike approved the judgment recently after the defendant in the civil case, Seth Robinson of Poland, did not respond to the lawsuit.

The case began in 2005 when Robinson, then 19, was charged with felonious assault and underage consumption in New Waterford.

Robinson was charged after village police said he punched Larry Athey Sr., 59, of West Main Street, New Waterford, Sept. 17 in the parking lot of the Vittle Village in New Waterford.

According to a report by New Waterford Patrolman Chris Albert, Athey apparently lost consciousness after the blow, fell to the ground and hit his head on the pavement.

The two men had exchanged words.

Before that, Athey had taken out a sheath knife, and then put it away. He put items in his vehicle, came back, and Robinson hit him.

Athey was taken to St. Elizabeth Health Center, where he was treated for bleeding and swelling of the brain and “possible neurological damage,” the report says.

He later died.

Judge Pike in an earlier ruling said the facts were not in dispute. When there was no response from Robinson, he granted the judgement.
