Federal appellate court rejects appeal by condemned Ohio killer of 3
CINCINNATI (AP) — A Nazi sympathizer who has spent 27 years on Ohio’s death row is making a last-minute appeal to the U.S. Supreme Court to delay his execution based on comments against the death penalty by a state Supreme Court justice.
Frank Spisak is scheduled to die Thursday for killing three men at Cleveland State University as part of what he called “hunting parties” to find and shoot blacks.
The 57-year-old Spisak says recent comments by Ohio Supreme Court Justice Paul Pfeifer opposing the death penalty are a sign capital punishment has been carried out unconstitutionally in Ohio.
Spisak attorney Michael Benza says he is appealing to the U.S. Supreme Court after the 6th U.S. Circuit Court of Appeals in Cincinnati today rejected Spisak’s argument on technical grounds.
