Pa. couple blames bagel for positive drug test, sues

Thursday, October 28, 2010

PITTSBURGH (AP) — A Pennsylvania couple claims in a lawsuit that their newborn was taken by county officials when a test the mother took came out positive for drugs after she ate a poppy seed bagel.

The American Civil Liberties Union filed the lawsuit today against the Lawrence County Children and Youth Services and Jameson Health System on behalf of Elizabeth Mort and her fiance, Alex Rodriguez.

The lawsuit says the couple’s 3-day-old daughter was taken from their home in April and held for five days before authorities admitted they had made a mistake.

Mort says she ate a poppy seed bagel the day before she was given a urine test by Jameson Health System. The lawsuit says the test came out positive and the hospital contacted the county despite having no other evidence that the baby was in danger.
