Woman indicted in death of boyfriend

A Mahoning County grand jury has indicted a woman charged with running her boyfriend over with his own car and a man accused of improperly using government equipment.

The grand jury indicted Kimberly Mack, 46, of 826 Woodford Ave., on two counts of aggravated vehicular homicide. She was arrested on the South Side in late July.

Police arrested Mack after they found her intoxicated and standing over the body of 64-year-old James Jackson of West Evergreen Avenue screaming, “My baby! my baby! Save him.” Police say Jackson died after being run down by a motor vehicle.

Mack told officers she and Jackson had been at a funeral home earlier in the day and had been drinking throughout the course of the day. She said she came to the house and found Jackson lying in the driveway after Jackson asked her to come to the house.

Mack was shown to have a blood-alcohol level of 0.205 after being tested by police, more than twice the legal limit of 0.08.

Officers at the scene of the incident noted that Mack had the keys to Jackson’s Cadillac in her possession and admitted to driving the car. The officers also noted a list of signs that showed Jackson had been run down with the Cadillac.

Joseph Marscio, 42, of Winterpark Drive, Austintown, a former Austintown Township dispatcher, was indicted on the felony charge of unauthorized use of property, tampering with records and possessing criminal tools.

According to police, Marscio had misused the Law Enforcement Automated Data System, which stores criminal histories and other information. Police began looking into Marscio’s actions in early May after a complaint was filed by an officer in the department.

Marsico was fired from his job as a dispatcher with the township in late May.
