Man charged with role in Warren drive-by shooting bound over to Trumbull Co. grand jury

Thursday, April 30, 2009

WARREN — Marcus L. Yager, 22, of Vine Avenue Northeast has waived a preliminary hearing and had his case bound over to a Trumbull County grand jury on two counts of complicity to murder.

Yager, who called himself “Little Montana” on his Myspace page on the Internet, is among three men accused in the April 13 drive-by shooting deaths of Lloyd McCoy Jr., 11, and Marvin J. Chaney, 26, at a home on Wick Street Southeast.

Yager was led into the courtroom today under guard of several Warren police officers and agreed to have his case heard by a grand jury. Judge Thomas Gysegem of Warren Municipal Court continued the status of Yager’s bond, which is that Yager is not eligible to be released on bond pending action by the grand jury.

Two other defendants, Eugene M. Henderson, 25, of Lane Drive Southwest, and Eugene Cumberbatch, 26, of Front Street Southwest, will appear for preliminary hearings at 10:15 a.m. Friday in the same court on two counts of aggravated murder.

Police say the suspects fired a high-powered rifle into the house, causing about 20 bullet holes and hitting Lloyd, Chaney, and Joshua McCoy, 3. Joshua McCoy was hit in the shoulder but is recovering well.
