YOUNGSTOWN — The Mahoning County Board of Elections is leaving the question of David P. Aey’s eligibility to be a write-in candidate for sheriff in the hands of the secretary of state.

The board voted 2-2 today along party lines on whether to certify Aey as a write-in candidate, a tie that must be broken by he secretary of state.

Sheriff Randall Wellington has filed a protest against Aey’s eligibility saying he can’t run as a write-in and questions if he has the education requirements needed to be a candidate for the seat.

Aey says he has.

The board will meet Sept. 18 to determine whether Aey has the needed education requirements.
