Suspect indicted in cop struggle

Saturday, March 31, 2007

A homicide was linked to drug trafficking, the prosecutor said.
YOUNGSTOWN -- A Mahoning County grand jury has indicted a North Garland Avenue man on felonious assault and aggravated robbery charges. He was shot by a policeman in Wick Park during a struggle.
Bienvenido Carmona, 40, was indicted Thursday in the March 12 episode, in which Patrolman Jerry Stanley shot Carmona in the hand. Police said the shooting occurred after Carmona beat Stanley with a copper pipe and tried to take Stanley's gun.
In another case, the grand jury issued a superseding indictment adding a charge of involuntary manslaughter with a firearm specification against a man whose alleged accomplice in a robbery was killed Feb. 22 in a Randolph Street home.
The superseding indictment is against Larese Jones, 29, of Mahoning County jail, who was initially indicted secretly on March 1 and captured in Akron a few hours later. Jones is still charged with murder in the death of Richard Helms, 43, of Himrod Avenue, who was shot inside the home; and aggravated robbery, together with aggravated trafficking in the painkiller OxyContin.
The murder charge says Helms died as a result of an aggravated robbery. The new involuntary manslaughter charge adds that Helms' death was "a proximate result" of aggravated trafficking in drugs.
David Klamer, 47, the resident of the Randolph Street home, who was also charged with murder, told police he shot Helms during a robbery. City Prosecutor Jay Macejko said Helms and Jones intended to rob Klamer. Jones was charged with murder because he was responsible for the death, which occurred as "a proximate result'' of the robbery, Macejko explained.
The same reasoning applies to the linkage between the drug trafficking and involuntary manslaughter charges, explained Martin P. Desmond, assistant county prosecutor.
Klamer, who threatened to harm himself after the shooting, was coaxed out of the house by a hostage negotiator.
